These Terms of Use ("Terms") govern your access to and use of the Kosova Models website, the member portal and the representation, scouting and booking services provided by Kosova Models ("Kosova Models", "the agency", "we", "us"). By using our website or services you agree to these Terms.
1. Acceptance of terms
By accessing this website, creating a member account, applying to be scouted, or engaging our services as a client, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the website or services.
2. About Kosova Models
Kosova Models is a boutique modeling agency founded in 2018 and based at Tahir Zajmi, Prishtina, Kosova. We represent models, artists and photographers, and connect that talent with clients, brands and productions worldwide. References to "talent" mean any individual represented by or applying to the agency.
3. Eligibility
You must be at least 18 years old to create a member account or enter into a representation agreement on your own behalf. Where a candidate is a minor, an application may only be submitted by, and a contract only entered into with, a parent or legal guardian who accepts these Terms on the minor's behalf.
You agree that all information you provide - including your name, contact details, measurements and images - is accurate, current and your own to share.
4. Member accounts
The member portal is provided to represented talent to manage castings, bookings, earnings, documents and a public profile. You are responsible for:
- keeping your login credentials confidential and not sharing your account;
- all activity that occurs under your account;
- notifying us promptly of any unauthorised access or security concern.
We may suspend or close accounts that are inactive, fraudulent, or used in breach of these Terms.
5. Representation
Acceptance of an application, or use of the member portal, does not by itself create a representation or employment relationship. Representation is governed by a separate written agreement signed by both parties. Nothing on this website constitutes a guarantee of bookings, income or placement.
6. Bookings & cancellations
Bookings are arranged by the agency on behalf of talent and clients. Confirmed bookings, call sheets, rates and usage terms are communicated through your dedicated booker and the member portal. Cancellation, postponement and weather-permitting terms are set out in each booking confirmation and the relevant client agreement. Late cancellation or no-show may incur fees as specified there.
7. Image & intellectual property rights
All content on this website - including text, design, logos, the "Kosova Models" name and the editorial photography - is owned by Kosova Models or its licensors and is protected by intellectual property laws. You may not copy, reproduce or redistribute it without written permission.
Talent retain rights in their own image except as expressly licensed to the agency and to clients for agreed usage. Usage rights, territories and durations for any given job are defined in the corresponding booking and model release.
8. Acceptable use
You agree not to:
- use the website or portal for any unlawful, fraudulent or harmful purpose;
- impersonate any person or misrepresent your affiliation;
- upload content you do not have the right to share, or that is offensive or infringing;
- attempt to gain unauthorised access to the portal, other accounts, or our systems;
- scrape, harvest or republish talent images or data without consent.
9. Fees & commission
Applying to be scouted and creating a member account are free. Where the agency secures paid work, agency commission and any applicable fees are set out in your representation agreement and itemised in the portal's earnings and billing sections. We never ask candidates to pay for representation, castings or portfolio review.
10. Disclaimers & limitation of liability
The website and portal are provided "as is" and "as available". To the maximum extent permitted by law, Kosova Models excludes all warranties and is not liable for any indirect or consequential loss, loss of opportunity, or loss arising from third-party clients, productions or platforms. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Termination
You may close your member account at any time. We may suspend or terminate access to the website or portal where these Terms are breached, where required by law, or where a representation agreement ends. Termination of representation is governed by the relevant signed agreement.
12. Governing law
These Terms are governed by the laws of the Republic of Kosova. Any dispute arising from them shall be subject to the exclusive jurisdiction of the competent courts of Prishtina, without prejudice to mandatory consumer protections in your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. Material changes will be communicated through the website or portal. Continued use after changes take effect constitutes acceptance.
